  1. You must have lived in NC for six months prior to filing for divorce.
  2. You and your spouse have been separated for at least one year. The period should be consecutive six months.

Grounds for divorce in NC only includes incurable insanity, and in cases where there is evidence of spouse misconduct, divorce from bed and board can be sought. Note that divorce from bed and board isn’t a divorce, but more of a request to the court for separation.
